Putu Bagus’ Dissertation Proposes Reconstruction of Advocate Honorarium Regulations

The Doctor of Law Study Program at Untar held an open doctoral promotion examination at Untar Campus I on Thursday (21/05/2026). During the session, Putu Bagus Dananjaya officially earned the 61st Doctor of Law degree awarded by Untar, graduating with distinction.

Putu Bagus successfully defended his dissertation entitled “Reconstruction of Advocate Honorarium Norms in Relation to the Binding Force of Authentic Deeds Based on the Philosophy of Justice” before an examination panel chaired by Untar Rector Prof. Dr. Amad Sudiro, S.H., M.H., M.Kn., M.M.

In his presentation, he explained that the development of society has led to increasingly diverse legal relationships, many of which are formalized through agreements. One example is the agreement between an advocate and a client, which regulates the rights and obligations of both parties, including matters related to honorarium arrangements.

According to Putu Bagus, advocate honorarium agreements hold an important position because they provide certainty regarding the rights and obligations of advocates and clients. Such arrangements may cover various forms of compensation, including lawyer fees, operational fees, and success fees.

He referred to Article 21 Paragraph (1) of Law Number 18 of 2003 concerning Advocates, which stipulates that advocates are entitled to receive honoraria for legal services provided to their clients. In this context, the use of authentic deeds is considered capable of strengthening legal certainty while enhancing evidentiary value in the event of future disputes.

His research findings indicate that the advocate honorarium system should be developed based on the principles of reasonableness, proportionality, transparency, and distributive justice. Furthermore, regulating honorarium agreements through authentic deeds can strengthen legal protection for all parties involved and promote professionalism in legal practice.

Putu Bagus also argued that such a regulatory model has the potential to provide a more balanced level of legal certainty for both advocates and clients, including justice seekers with limited financial resources.

His interest in this research topic is closely related to his professional background in the legal field. His practical experience encouraged him to further examine the regulation of advocate honoraria and the legal force of agreements executed through authentic deeds as part of efforts to strengthen legal certainty and justice.
