The Open Examination of the Doctor of Law Study Program (DIH) declared Sunarsih eligible to receive a doctoral degree with the distinction of very satisfactory on Monday (15/7/2024) at the Auditorium of Untar Campus I.
She earned the degree after successfully defending her dissertation entitled “The Adoption of the Estoppel Doctrine According to the Common Law Tradition in the General Provisions of the Law of Obligations under Book III of the Civil Code and Indonesian Customary Agreements.”
The research was motivated by the principle that the binding force of an agreement, whether written or unwritten, depends on the fulfillment of the legal requirements for a valid contract.
The study aimed to examine the adoption of the Estoppel Doctrine, which originates from the Common Law tradition, and the formulation of its values within the General Provisions of the Law of Obligations in Book III of the Indonesian Civil Code, which follows the Civil Law tradition. The research sought to determine how these principles could serve as a legal basis for recognizing the binding force of unwritten agreements.
The findings revealed that the values underlying the Estoppel Doctrine have been implicitly incorporated into the General Provisions of the Law of Obligations in the Civil Code. Similar principles were also found in Indonesian customary agreements, where the values of estoppel are reflected through the creation of symbolic markers as evidence of mutual consent and as a prohibition against denying promises that have already been agreed upon.
On the occasion, Prof. Dr. Gunardi Lie, S.H., M.H., as Principal Supervisor, expressed his hope that Dr. Sunarsih would continue to contribute and innovate in her field of expertise, both professionally and academically.
“I see that she has a strong passion for education because I have worked with her for nearly ten years as an instructor in mediator training programs at the Faculty of Law (FH) of Untar,” he said.
The open examination was chaired by Untar Rector Prof. Dr. Ir. Agustinus Purna Irawan, M.T., M.M., I.P.U., ASEAN Eng., Serving as examiner and principal supervisor was Prof. Dr. Gunardi Lie, S.H., M.H., while Prof. Dr. Amad Sudiro, S.H., M.H., M.M., M.Kn., served as co-supervisor.
The examination board also consisted of Prof. Dr. Mella Ismelina F.R., S.H., M.Hum., Prof. Dr. Ariawan Gunadi, S.H., M.H., Prof. Dr. Abdul Gani Abdullah, S.H., LL.M., Dr. Gunawan Djajaputra, S.H., S.S., M.H., and Handa S. Abidin, S.H., LL.M., Ph.D.
Dr. Sunarsih previously graduated as the top-ranked student in Untar’s Undergraduate Law Program, the second-ranked graduate in Untar’s Master of Law Program, and has now become the 38th graduate of Untar’s Doctor of Law Program. (DP/YS/KJ)
