Aditya Linardo Examines the Ideal Criminalization Framework for Non-Compliance with Court Decisions in Doctoral Defense

The Doctoral Program in Law at Untar held an open doctoral promotion examination on Saturday (06/06/2026) at Untar Campus I. During the session, Dr. Aditya Linardo Putra was officially declared successful and awarded the title of the 65th Doctor of Law graduate from the program.

The promovendus defended his dissertation entitled “The Ideal Criminalization Concept for Failure to Execute Final and Binding Court Decisions as Contempt of Court” before the examination board.

In his dissertation, Dr. Aditya Linardo Putra examined the issue of non-compliance with court decisions that have obtained permanent legal force (inkracht). The study highlights that the failure to execute court decisions poses a threat to legal certainty and the authority of the judiciary and may be categorized as a form of contempt of court, which has yet to be explicitly regulated under Indonesian criminal law.

“The issues examined in this study include the regulation of contempt of court under Indonesia’s positive law, the urgency of criminal sanctions for non-compliance with final and binding court decisions, and the ideal regulatory framework that could enhance the effectiveness of court decision enforcement,” the newly conferred doctor explained during his defense.

The research employed a normative juridical method with a descriptive-analytical approach, utilizing secondary data obtained through literature studies. The study incorporated statutory, conceptual, and comparative approaches. Data analysis was conducted descriptively and analytically, with conclusions drawn through deductive reasoning.

Dr. Aditya, who also serves as Managing Partner at the law firm LLM & Partners, concluded that contempt of court has not been clearly regulated within Indonesia’s legal system. Existing provisions remain inadequate to address violations involving non-compliance with court decisions, a condition that contributes to the weakening of judicial authority.

“This study also finds that non-compliance with court decisions that have obtained permanent legal force constitutes a form of defiance against judicial authority. Existing enforcement mechanisms have not provided an optimal deterrent effect. Therefore, a specific criminal regulation based on the concept of contempt of court is needed to strengthen legal certainty and the authority of the courts,” Dr. Aditya concluded.

The open examination was chaired by the Rector of Universitas Tarumanagara, Prof. Dr. Amad Sudiro, S.H., M.H., M.Kn., M.M., who also served as the chair of the session and the promovendus’ principal promoter. (VC/YS)
