Luo Yuan Yuan, First International Student to Earn a Doctorate at Untar

Luo Yuan Yuan became the first international student to earn a doctoral degree from Untar. She successfully defended her dissertation titled “Investment Dispute Settlement Mechanism: A Comparative Study between Indonesia and China” at the Public Defense of the Doctoral Program in Law (Prodi DIH) of the Faculty of Law (FH) Untar in the Auditorium of Untar Campus I on Thursday (21/11/2024). Yuan, who comes from China, conducted research on the challenges of the global economy, which has managed to recover and continue to develop despite facing major crises such as wars, pandemics, and other problems. In presenting her research, she stated that entering the 21st century, the global economy has been growing rapidly, with increasing cross-border economic activities. Therefore, investments play a crucial role in this economic activity, leading to predictions that investment-related disputes will also rise. As Indonesia’s largest trading partner, China became the second-largest investor in Indonesia up to the year 2020. Thus, the research focuses on disputes between private investors and states, as well as the dispute settlement mechanism known as Investor-State Dispute Settlement (ISDS) between Indonesia and China. Although the dispute resolution provisions between investors and states differ in investment agreements, in general, these provisions regulate dispute resolution through arbitration. Yuan’s research findings indicate that the World ISDS System must be built with a “Triangular System”, consisting of Alternative Dispute Resolution (ADR), local remedies focusing on local litigation, and a multilateral investment court. ADR and local litigation are at the same level, where investors can choose one of the two as a prerequisite for seeking resolution in a multilateral investment court. On the same occasion, Yuan expressed her respect for being able to pursue the doctoral program at FH Untar with the scholarship provided by Untar. Additionally, she also expressed gratitude to the lecturers at Untar who guided her until graduation. Yuan was declared to have graduated with a perfect Grade Point Average (GPA) and became the 42nd graduate of the Doctor of Law Program at Untar.
